병원윤리위원회의 기대 역할에 기반 한 윤리 딜레마 해결 모형

본 논문은 사회적으로 그리고 의료계에서 병원윤리위원회 및 각 구성원에게 기대하는 역할을 기반 한 임상 윤리 딜레마 해결 모델을 개발하는 과정을 거침으로 실천 가능한 윤리적 절차로의 해결 모델을 개발 제안하고자 하였다. 윤리적으로 미흡한 부분에 대해서 보조적인 윤리 장치로 일반적인 규칙과 경험을 규칙화시킬 수 있는 방법을 제안함으로 들을 병원윤리위원회의 윤리 딜레마 해결의 실마리를 찾고자 했다.

우선 미국과 유럽의 여러 나라 및 우리나라에서의 병원윤리위원회의 역사, 목적, 기능 및 운영 형태 그리고 이를 정당화시키는 이론등을 알아보았다. 기존의 임상에서의 윤리 딜레마 해결 형태인 그룹 접근 방법과 컨설턴트 방법의 문제점과 정당화 어려움을 알아보고 이를 극복하기 위하여 요구되는 윤리성 획들을 위한 형식적인 절차에서 찾아야 함에 대해 논의하였다. 이 과정에서 임상에서의 윤리적 딜레마의 내재적 특성으로 사회적, 경제적, 심리적, 법적 부담을 동반함을 알아보았다. 병원윤리위원회가 당면하는 윤리적 딜레마 해결의 어려움을 극복하기 위하여 환자의 자율적인 의사에 대한 동등한 접근의 원칙을 가장 우선적으로 딜레마 해결에 적용하고 부담의 최소화 과정을 포함시켜 그 절차를 제시하였다. 이를 병원윤리위원회에게 기대 되는 역할인 1) 딜레마 평가, 2) 딜레마 해석, 3) 도덕적 판단 그리고 마지막으로 4) 위기 관리에 맞게 절차를 개발하였다.

이 방법은 1) 많은 도덕적 이론 원칙 중에서 자율성 존중의 원칙을 가장 우선적인 원칙으로 채택하여 그 실질적인 적용을 용이하게 하였고 2) 윤리적 딜레마에 대한 의사 결정에 동반하는 많은 부담을 동시에 해결하되 적극적으로 실행, 그 해결 범위를 넓힘으로써 그 도덕 결정의 실행을 담보하였다는 데 특징이 있다. 본 모델은 구성원들은 각 단계별 각 분야별로 자신에게 주어진 역할을 절차에 맞게 수행하면 윤리적인 결정에 이르고 또한 그 결정에 대한 당사자들의 부담 및 구성원들의 심리적인 부담을 덜 수 있도록 구성되어 있다. 이 절차의 가장 큰 단점은 환자의 자율적인 의지가 있거나 보호자가 환자의 최선의 이익을 대변할 수 있는 경우에 결정이 가장 윤리적으로 되는 반면 환자의 의지를 알 수 없거나 보호자가 환자의 이익에 반대되는 요구를 가지고 있는 경우 다시 많은 이론적인 도덕 원칙에 근거한 합의의 형식을 빌릴 수밖에 없다는 데 있다.

The number of hospital ethics committees in Korea is growing as the needs for clinical ethics dilemma resolution is increasing, but as the history of HEC is short in Korea there has been no established model for the purpose. The object of this article is to develop an ethics dilemma resolution model for Korean hospital

ethics committee.

Ethics dilemma in Korean clinical setting is based on patient-family-doctor relationship and the financial, social, legal and psychological burdens are inevitable in the resolution process of ethics dilemma. Based on these two factors the process of dilemma resolution were based on the expected roles of HEC members;

dilemma assessment, dilemma interpretation, moral judgement and risk management.

Dilemma assessment process is composed of assessment of the dilemma situation of the patient or the patient-family and the factors other than patient family, i.e. medical, social resources, and social which includes legal, religious and ethical

dilemma situation. The interpretation process is composed of moral and risk interpretation. In this level of process ‘Respect for Autonomy’principle is taken as the prima facia principle and the interpretation is taking place based on the competency of the patient and the representative of patient best interest. Moral

judgement process then precede risk management so that resulting burdens could not outweigh the morality of the decision making. The risk management will take place in financial, social, legal and psychological aspects of the family and patient. By minimizing the burdens of the family and the patient the moral decision can become truly practicable.

This clinical ethics dilemma resolution model forcuses on the moral security of the decision making while making it practical by employing the process of risk management throughout the model.
