의료분야 전자상거래 법적 고찰과 정책방향

Abstract

[한글]인터넷은 모든 국가 및 경계로부터 규제와 단속이 없는 네트워크를 통한 자유로운 정보의 흐름을 보장하고, 자유스러운 정보의 공유, 자유분방한 의사의 개진과 자기표현을 기본정신으로 발전되어졌다. 모든 것으로부터의 자유로운 사이버스페이스, 인터넷이라는 생각이 지금의 단계까지 발전시켰고 다양한 형태로 전자상거래 영역은 점차 넓어지고 있다. 의료분야도 다른 기업이나 산업과 마찬가지로 상업적 거래의 요소를 가지고 있으므로 의료광고, 인터넷 약국, 의료용구의 거래, 건강보조식품의 유통에서 전자상거래가 이루어지고 있다.

인터넷은 우리에게 많은 혜택을 주고 있지만, 인터넷이 좋은 면만을 가지고 있지 않고 나름대로의 문제점을 안고 있으며, 이러한 문제점을 해결함으로써 인터넷이 보다 확산될 수 있도록 인터넷상에서 거래되는 전자상거래 개념과 의료분야에서 활용되는 전자상거래의 유형과 현황을 살펴보고 전자상거래를 활성화시키기 위한 기술적인 요건과 위험요소, 제약요인을 분석하였다. 또한 인터넷 매체를 이용 손쉽게 접근할 수 있는 의료광고의 질과 제공되는 의료광고 범위에 대한 논의, 인터넷약국의 의약품공급과 인터넷약국이 도입되면 그에 따르는 법률적인 문제점과 의료분야의 조직간 거래에서 전자거래 되는 의료용품의 안전성과 유효성의 허용범위의 기준을 제시하도록 정책방향을 세워야 한다. 건강에 대한 관심의 고조로 건강보조식품의 유통을 전자상거래 도입으로 개선시키도록 한다. 그러므로 의료분야에서 전자상거래가 활성화될 수 있도록 그에 따르는 법률고찰과 정책방향을 제시해본다.

[영문]With improvement of internet technology, electronic commerce (EC) has been rapidly disseminated to business industry as well as healthcare industry. Applications of EC in healthcare include internet advertisement, online drug store, online medical supply store, and online health food store, etc. However, current legal as well as regulatory constraints limit to the further growth of EC in healthcare. In this study, therefore, such legal and regulatory constraints were reviewed first, and then recommendations to reduce these constraints were made based on the review of foreign legislations on EC. In addition, technical aspects of EC were also reviewed to examine how technology affects EC in healthcare.

As a result, the followings recommendations were made: to allow educational backgrounds of doctor at websites to provide more information (and thus more choice) to patients, to establish review committee for EC within professional societies, and to establish standards for communication and electronic documents. However, online drug store was recommended to open in a phased approach to reduce a potential conflict with pharmacists.
