전염병관리 관련법령의 변화 추이분석 및 향후 개정방향에 관한 연구

Abstract
[한글]

본 연구는 우리나라 전염병예방법의 일부 개정방향을 제시하기 위하여 우리나라와 일본, 독일, 미국, 프랑스, 영국의 전염병예방법이 제정된 이래 최근까지 개정된 주요 내용과 관리하고 있는 질병의 종류와 발생시 보고 여부 등을 국가별로 비교 분석하였다. 전염병으로 지정할만한 기준 마련을 위하여 우리나라의 법정전염병과 외국의 법정전염병을 치명률10%이상 - 미만여부, 유행가능성 유무, 예방접종 유무, 그리고 격리의 효과유무등 4가지 항목을 고려한 전염병예방법 지정타당도를 개발 적용하였다. 본 연구 결과를 요약하면 다음과 같다.

첫째, 우리나라, 일본, 독일, 미국, 프랑스, 영국에서 공통으로 정하고 있는 전염병은 콜레라, 페스트, 황열, 디프테리아, 장티푸스, 폴리오, 공수병, 파상풍, 마라리아, 수막구균성수막염 등 10개 질병이었다.

둘째, 우리나라에서 전염병으로 정하고 있지 않으나, 위 5개국에서 전염병예방법으로 정하고 있는 대표적인 질병으로는 두창, 랏사열, 인플루엔자, 풍진, E. coli O157:H7, 탄저, 레지오넬로시스, Q-열, 브르셀로시스, 라임병 등 34개 질병이었다.

셋째, 우리나라의 전염병예방법에서 지정하고 있는 법정전염병을 본 연구에서 제시한 지정타당도 기준을 적용한 결과는 다음과 같다.

가. 네가지 항목에 만점을 얻은 페스트는 사망률도 높고 발생 가능성도 있으며 관리에 예방접종과 격리 모두 효과가 있는 경우이다.

나. 3점을 받은 질병은 디프테리아, 세균성이질, 백일해, 유행성이하선염, 일본뇌염, 유행성출혈열 등 6개 질병이었다.

다. 4가지 항목에서 2점을 받은 감염병은 발진티푸스 등 12개 질병이었다. 이중 황열은 우리나라에 매개곤충이 없으며, 질병 속성상 산발하는 공수병과 파상풍은 치명률은 높으나 큰 유행가능성이 없어 우선 순위가 낮은 병으로 계산되었다.

라. 그외 1점을 받은 질병중에서도 성병은 사회적으로 큰 문제가 야기될 수 있으므로 신중히 관리할 필요가 있다.

네째, 외국에서 법으로 관리하고 있는 질병중 우리나라에서 법정전염병으로 지정되지 않은 12개 질병에 대해 지정타당도 기준을 적용한 결과는 다음과 같다.

가. 풍진은 네가지 항목기준 모두 해당하여 4점을 얻었고 탄저병과 E. coli O157:H7 이높은 점수인 3점을 얻었다.

나. 인플루엔자와 레지오넬라증이 2점을 얻었고, 랏사열, Q - 열, 브르셀라증, 신생아안질환이 1점을 얻었다.

다. 그러나 라임병과 두창은 유행가능성 또는 치명률을 알 수가 없어 평가할 수 없었다. 이중 라임병은 구 소련과, 중국, 일본에서도 발생되는 것으로 보아 국내 발생을 면밀히 관찰해야 할 질병으로 생각한다.

결론적으로 전염병예방법의 다음 개정시에는 기존의 지정전염병은 물론 외국에서 지정한 질병들도 본 연구에서 제안한 것 또는 더욱 개발된 좋은 기준을 기초로하여 지정 타당성을 검토하는 것이 바람직하다고 생각한다.

[영문]

This Study has been carried out to make a recommendation for the next amendment of the Infectious Disease Prevention Act with a specific focus on the kind of notifyable disease. Korean, Japanese, German, U.S, English and French acts on infectious diseases prevention were reviewed, compared with and analized in regards of numbers and kinds of notifyable infectious diseases and their tendency of amendments.

An criteria was designed to assess the level of validity of diseases to be designated in the act. Four items, the fatality (greater than 10% or not), the possibility to make a big epidemic, the availability of efficient vaccination and the usefulness of isolation, are used in the assessment. This index is applied to the diseases in Korean and other countries' Infectious Disease Prevention Acts.

Results are as follows :

1. The Korean Infectious Disease Preventon Act has a unique way of classifying the notifyable infectious disease, that is, the first, the second and the third class. But the author cannot find the basis of classification. No other countries reviewed have the similar classification.

2. The ten diseases, cholera, plague, yellow fever, diphtheria, typhoid fever, poliomyelitis, rabies, tetanus, malaria, and meningococcal meningitis are designated as the notifyable diseases not only in Korea but also in Japan, Germany, United States, England and France.

3. Thirty seven diseases including small pox, Lassa fever, anthrax, influenza, German measles, Legionellosis, infection with E. coli O157:H7, Q-fever, brucellosis, Lyme disease are designated as legal disease at least one of the above mentioned countries.

4. The Korea has been coped with the change of the infectious disease occurrence for last fifty years in amendment of the Infectious Disease Prevention Act.

5. Japan has a special infectious surveillance system composed of 3,880 clinics throughout the whole country.

6. Germany has classified infectious diseases in five categories which are based on seriousness of disease. Any confirmed death, cases and suspected cases in class Ⅰ should be reported within 24 hours. But only confirmed death and cases in class Ⅱ, but not suspected cases, are repotable in Germarny.

7. Plague, bacillary dysentery, pertussis, mumps, Japanese encephaltis and Korean hemorrhagic fevers are diseases with high credits validity index among Korean legal disease.

8. German measles, anthrax, E. coli O157:H7 infection, Lassa fever, Q-fever, brucellosis are high in validity index among those which are not designated in Korea but designated in other countries.

In conclusion, the Korean Infectious Disease Prevention Act has well been coped with the changes of infectious disease occurrence for last fifty years, but the classification basis and the validity of diseases to be designated as legal diseases is worth reevaluating.
