우리나라 검시행정 실태에 관한 연구

인간에 있어서 가장 고위하고 소중한 것이 생명이라면 사람의 죽음 역시 소훌히 되거나 어떠한 억울한 죽음이 있어서는 아니된다. 국가는 소외되고 억울한 죽음이 없도록 하기위하여 검시제도를 설치하고 이를 잘 운용함으로 보다 발달된 형태의 민족집단을 이끌어 나가게 된다. 그러나 이 검시제도는 각국에 따라 다양한 형태로 차이가 있는 바, 이는 그 국가 민족의 특성이나 인식 또는 문화와 전통 등이 모두 다르기 때문이라 할 수 있다. 우리나라는 전통적으로 대륙법계의 겸임 검시제도 중 사법검시 위주제도를 채택하여 왔다. 겸임검시 제도란 검시를 담당하는 사람이 검시에만 종사하지 않고 다른 자기 고유의 업무(검사, 판사, 경찰관, 의사)를 하면서 검시 업무를 겸하는 제도로서 그렇기 때문에 검시 업무상 많은 문제점들이 도출되고 있다. 본 연구는 여기에 초점을 두어 현행 우리나라의 검시제도와 이에 따른 실행 단계에서의 문제점을 파악하고, 비교적 잘 되었다고 생각되는 외국의 검시제도와의 비교를 통한 개선책을 제시하는 것 등을 목표로 하였고, 그 결과 다음과 같은 결론에 이르렀다.

검시에 참여하는 사람들이 검사, 경찰관, 판사, 의사 등 4직종이므로 검시행정에 있어서 유기적 연관성이 부족되고 검시 주체상의 문제점이 있다. 검시의 주체가 검사라고 하지만 실행단계에 있어서 다른 직업인이 필수적으로 소요됨으로 인해 그 책임의 한계가 모호하다. 또한 검시의 일익을 담당하는 의사의 경우도 현행 법률상 특별한 자격이 요구되어 있지않고, 검시를 위한 기초법의학 교육이 빈약하므로 인해 검시담당의사의 전문성 결여가 문제된다.

이를 극복하기 위하여는 다음 세가지 사항이 선행되어져야 되리라 본다.

첫째, 검시 책임의 명확을 위해 실재 일을 수행하는 사람이 검시의 주체가 되도록 하며,

둘째, 전담검시제도를 도입하도록 하고,

셋째, 검시에 참여하는 의사들의 이에 대한 전문적 교육을 필요로 한다.

This study analyzed problems of postmortem investigation system in Korea. It is essential to improve postmortem examination system to identify exact cause of deaths.

Through the literature review, his study found that the system of postmortem examination in Korea is different from that of the foreign nations such as U.S.A, England, Singapore etc. For the purpose of identifying the problems of the system, the author analyzed the autopsy reports which were prepared by medical examiners in National Institute of were prepared by part-time service district doctors based on their inspection.

The following results were obtained:

1. The accurate statistics on postmortem examinations in Seoul cannot be be properly otained because the procedures for postmortem examination has not been clearly established.

2. According to the death certificates (by inspection) which were prepared by part-time service district doctors, the causes of deaths can not be determined exactly since 66.5% were examined. It is pointed out that the medicolegal education is in adequate and not specialized in Korea.

3. To overcome these problems, more comprehensive postmortem examination system (such as the Anglo-American Law) should be established in Korea.
