응급의학전문의들의 설명의무에 대한 인식 고찰

근자에 들어와 설명의무 위반을 주된 소송이유로 하는 의료소송이 증가하고 있다. 의료에서 설명의무의 필요성에 대해서는 모두가 인정하고 있으며 적절한 설명의무의 이행을 위해 의료계도 나름대로의 노력을 하고 있으며 법조계에서도 적지 않은 연구가 있었다. 그러나 응급의료 영역에서의 설명의무에 대해서는 체계적인 논의가 없었다. 이제까지 응급의료에서는 설명의무가 면제될 수 있다는 견해가 다수 의견이었으나 관계법률인 응급의료에 관한 법률에서는 명시적으로 응급의료종사자의 설명의무를 규정하고 있어 응급의료에서의 설명의무에 대한 법적, 의료적 논의와 연구가 필요하게 되었다.

연구자는 설명의무에 대한 기존의 논문 고찰을 통해 법조계의 다수견해를 정리해 보고 이를 응급의료종사자인 응급의학 전문의 대상의 설문조사 결과와 비교함으로서 응급의료에서 설명의무와 관련한 문제들을 의사와 환자 모두에게 도움이 되는 방향으로 정립하는데 유용한 기초 자료로 사용되었으면 하는 의도를 가지고 연구를 계획, 수행하였다.

의사의 설명의무에 대해 법조계에는 이를 법적의무로 보고 일반적인 법률관계에서의 권리와 의무의 법리에 따라 규정하는것이 다수 의견이었으나, 응급의학 전문의들은 의사의 설명은 법률관계이기 이전에 의료행위의 일부분이기에 다른 의료행위와 마찬가지로 직업윤리적 양심에 따라 수행해야 하는 의무로 이해하고 있었다.

응급의료에서는 응급상황이라는 특수성이 설명의무를 면제시킬 수도 있다는 것이 법조계의 다수 견해이자 판례의 태도이나 응급의학 전문의들은 응급의료에서의 설명의무도 일반 의료에서와 동일하며 단지 응급한 상황이기 때문에 그 이행이 연기될 뿐이라는 시각을 가지고 있었다. 그리고 응급의료의 성격에 비추어 볼 때 법률에 제시된 획일적인 설명 및 동의 서식은 의료현장에서 사용하기에는 적절치 않고 응급의료의 진행 단계별로 적합한 설명이 이루어져야 한다고 보고 있었다. 심폐소생술 같은 가장 위급한 응급의료 상황에서도 설명의무는 있으나 그 이행은 응급상황이 정리될 때까지 어느 정도 연기될 수 있다고 생각하고 있었다. 즉, 시작은 설명과 동의의 절차 없이 의사의 직업윤리적 판단에 따라 가능하지만 중단은 적절한 설명과 동의 아래에서 가능하다는 것이 주된 의견이었다. 경증의 환자에 대해서도 설명의무는 응급실이라는 이유만으로 면제되거나 가벼워지지 않는다고 인식하고 있었다.

[영문]The number of litigations against the medical profession is on the rise. The main issue is the violation of informed consent. The medical society is encouraging its members to inform their patients. On the other hand, the legal society is doing a considerable amount of study on the subject. However, there has not been any systematic debate on the subject for emergency medical situations. The exemption of the informed consent in emergency medical situations seems to be the common notion. Nevertheless, the recently enacted Emergency Medical Services Law mandates the provision of informed consent in emergency medical situations by the emergency medical personnel. Therefore, a systemic research focusing on the informed consent in emergency medical service was necessary.

The informed consent in emergency medical service is an unexplored field and a subject of social medical science. This study utilizes qualitative study methods. The results of the survey on the opinions of emergency physicians was compared to previous studies by the legal community on informed consent

The majority of opinions in the legal society arethat the informed consent is a legal duty, andaccordingly, they interpreted it as a general legal principle. But the emergency physicians don''t think of it as a legal duty. They see it as a part of much professionalized medical act, not a general legal matter. Therefore, the professional ethics should guide the acquisition of informed consent.

The majority of opinions in the legal society and the judicial precedents are exemption of informed consent in an emergency. But the emergency physicians see the informed consent in Emergency medical service equal to that of usual medical situation, only that it can be delayed in an emergency. The emergency physicians have to provide an appropriate explanation for each step of the process, but aunified form of informed consent provided by the law is just not suited.

An informed consent should be acquired even in an emergency like CPR(cardio pulmonary resuscitation), but only that it can be until the end of emergency. Professional ethics should guide the initiation of CPR without acquiring an informed consent. But the termination of CPR should be under the informed consent.

Non-urgent patients should receive informed consents, even in an overcrowded emergency room, same as in the usual medical situations, the duty is not release or relieve solely on the reason that it is an emergency room.
