의료기관 윤리성 검토기구 정비를 위한 법률 개정 연구

Abstract

[한글]본 연구는 의료기관에서 발생하는 윤리적인 문제에 대한 검토기구로서 윤리위원회의 운영 현황을 파악하고 이들에 대한 효율적인 개선 방안을 마련하기 위하여, 윤리위원회 설치에 대한 근거가 되는 법령 등을 분석하고, 윤리위원회를 운영 중인 90개의 병원급 이상 의료기관을 대상으로 인터넷 설문조사를 실시하였으며, 총 43개 의료기관의 윤리위원회 담당자로부터 답변을 받았으며, 그 결과는 다음과 같다. 1. 의료기관의 윤리위원회는 그 법적 근거에 따라 기관생명윤리심의위원회는 93%, 임상시험심사위원회는 83.7%, 뇌사판정위원회는 44.2%, 병원윤리위원회는 53.5%, 실험동물윤리위원회는 20.1%, 동물실험윤리위원회는 39.5%가 설치되어 있으며, 한기관에 많게는 7개 모두 각각 설치하여 운영하고 있다. 2. 의료기관의 많은 윤리위원회는 그 중요성에 비해 전담인력의 부족, 유사한 위원회가 많아 관리의 어려움, 과다한 행정업무, 기관의 지원 부족, 인식과 전문성 부족 등으로 운영상의 많은 어려움에 직면하고 있는것으로 조사되었다. 3. 의료기관의 윤리위원회는 기관생명윤리심의위원회와 임상시험심사위원회 등을 중심으로 중복기능이 많아 실제로 회의를 중복해서 운영하고 있는 경우가 다수 조사되었고, 법 규정의 정비를 통해 적극적으로 통합운영의 토대가 시습하다는 의견 등이 조사되었다. 따라서 이번 연구 결과를 바탕으로 향후 변화하는 의료환경과 생명과학기술 분야에 새롭게 발생하고 있는 윤리 문제에 대해 적절히 대처할 수 있도록 현행 생명윤리 및 안전에 관한 법률을 개정함으로써 윤리문제에 직면시 적극적인 대응과 법적 및 심리적인 지원을 해주는 동시에 환자를 기피하지 않고 정당한 의료서비스가 보편화되고 발전될 수 있는 기회가 될수 있을 것이며, 나아가 우리나라가 국제적으로 생명윤리 분야에서 선도적인 역할을 할 수 있을 것으로 사료된다.

[영문]This study was conducted to survey of the current operational

status of ethical committee, an organization to review ethical issues raised at medical institutes, and to establish efficient improvement plans for its operation. For these purposes, we analyzed the laws and regulations which are grounds for establishment of ethical committee and conducted an internet survey with ninety hospitals where an ethical committee is

operated. Total forty three of them were responded and the results are as follows.

1. Among the responding institutions, 93% had Institutional bioethics Review Boards; 83.7% had Institutional Review Boards; 44.2% had The Brain Death Decision Committees; 53.5% had Hospital Ethics Committees; 20.1% had Committee on Ethical Treatment of Laboratory Animals; and 39.5% had Institutional Animal Care and Use Committees. One of them had even seven committees.

2. The results showed that, in spite of their importance, many

ethical committees have confronted a lot of operational difficulties caused by, but are not limited to, the following reasons: lack of staff who are exclusively responsible for the work, managerial difficulties because of excessive existence of similar committees, heavy administrative workloads, shortages of institutional support and lack of acknowledgement and professionalism for the work.

3. The results showed that many hospitals had held the meetings of several ethical committees at the same time because their functions are considerably overlapped: especially, Institutional bioethics Review Boards and Institutional Review Boards have similar functions. In addition, the opinion that unified operation of committees is necessary based on the revision of relevant laws and regulations was raised.

Therefore, based on the results of this study, we suggest that the current Bioethics and Biosafety Act should be revised in order to cope with changes in medical environment and new ethical issues in the field of life science. And we think that the revision of the Act would urge medical institutes to deal with ethical issues actively and provide patients with proper access to medical services as well as with legal and emotional supports when they confront ethical issues. In addition, it would

contribute to the equitable distribution of medical services. Finally, we believe that this country could take a leading role in the field of bioethics in the international community.
