청소년수용기관 원생들의 의료법적 윤리적 문제에 대한 사례연구

수용시설에 수용되어 있는 수용자들도 국가의 보호를 받아야 하는 국민임은 틀림이 없다. 그러나 일정기간 수용기관에서 생활하고 있기에 그들은 일반국민과 비교했을 때 여러 가지 측면에서 열악한 상황에 놓여있게 된다. 또한 이들은 언젠가 사회에 복귀하여 생활하기 때문에 수용기관내에서 발생한 질병을 갖고 사회로 복귀하였을 때 발생할 수 있는 국가 전체적인 문제도 고려해야 한다. 그럼에도 불구하고 현재 우리의 현실에서 이뤄지고 있는 수용시설내 보건의료의 상황이 적절하지 않다고 판단된다. 기본적인 시설과 인력의 부족, 예산의 부족 등으로 보건의료와 관련된 행위는 거의 형식적으로 이뤄지고, 아주 크게 아프거나 고통을 호소하기 전에는 적절한 진료가 이뤄지지않는 것이 현실이다. 따라서 이러한 환경과 제도를 적극적으로 개선하여 이들이 수용기관내에서 생활할 때와 사회에 나왔을 때 발생할 수 있는 여러 가지 보건과 관련된 문제가 발생하지 않도록 만드는 것이 중요한 과제로 남는 것이다.

청소년 수용기관에서 발생할 수 있는 보건과 관련된 문제를 인식하기 위해서 수용기관에서 이루어지고 있는 여러 가지 제도들을 살펴보고, 이러한 제도의 틀 안에서 최대한 청소년들의 건강을 증진시킬 수 있는 방안을 모색함으로써 한정된 자원을 효율적으로 사용하고, 그 효과를 극대화 할 수 있는 방안을 찾아내야 한다. 결국 청소년 수용기관의 보건의료의 효과적인 운용을 위해서는 보건의료자원, 즉 인력, 시설 및 장비, 예산 등을 위한 장기적인 투자와 함께 전문 인력의 확보, 수용자들에 대한 지속적인 관리, 보건의료와 관련된 체계적인 업무환경과 업무과정의 분석을 통한 단계적인 질병관리 방안을 마련함으로서 더 나은 수용기관내 보건의료서비스를 제공할 수 있을 것이다. 더불어 이러한 내용을 법률에서 의무로 규정하여 수용자들의 건강과 국민의 보건을 지켜나갈 수 있으며, 그 외에도 수용기관에서 일하고 있는 관계 공무원들은 수용시설에 수용되어 있는 수용자들의 인권을 존중하여 그들이 행하고 있는 혹은 그들이 경험하고 있는 상황을 청소년 수용자들의 인권을 침해하지 않는 선에서 적극적으로 개입함으로써 수용자들이 안고 있는 문제들을 해결할 수도 있다.

[영문]Those in consignment facilities are no doubt citizens who should be protected by the government. However, because they are confined in facilities for a given amount of time, they are under poor conditions compared to the general population in many ways. Because they return to the society one day, a national issue regarding the possibility of the once consigned to bring with them the illness that they had while confined should also be considered. Despite the above, it seems that the current health care situation within the consignment facilities is inappropriate. Because of the shortage of basic facilities and manpower in addition to lack of health care budget, health care related service being provided is that of formality and unless someone is extremely ill or in pain, appropriate medical practice does not take place. Thus, it is an important issue to improve such an environment and system to make sure that various health care related problems are prevented.

In order to recognize the health related problems of juvenile consignment facilities, various current systems of the facilities should be considered and new plans need to be formulated to elevate the health of the adolescents so that the limited resources can be utilized efficiently and its effects maximized. In order to efficiently manage the health care of juvenile facilities, long term investments on health resources such as manpower, facility, equipment, budget, as well as the securing of experts, continuous management of the consigned, preparation of a step-wise disease control plan through a systematic working environment of health care and analysis of work process should be ensured so that a better health service would be provided within the facilities. In addition, through legislation the health of the juvenile and of the general citizen will be protected, and consignment facility-related public health officials will respect the human rights of those being consigned so that they may actively intervene on the actions of the situations of the juveniles without breaching their rights and will be able to come to appropriate solutions.
