의료사고를 경험한 가족들이 의료분쟁을 제기하는 원인에 대한 연구

이 연구는 의료 분쟁의 한 축인 환자측의 의료 분쟁을 제기하는 원인과 그와 관련된 특성을 분석하고자 의료 사고로 인해 의료사고 가족연합회를 방문하였던 234건을 대상으로 우편 설문 조사를 실시하여 분석된 주요 결과는 다음과 같다.

1. 의사 및 병원측의 설명 및 태도에 대한 만족도는 매우 낮았다.

2. 사고로 인해 가족들의 삶에 어려움이 있었던 경우가 많았다.

3. 의료 분쟁 제기 이유에 대한 요인 분석 결과에 태도에 대한 불만, 향후 사고방지, 책임 추궁, 보상 등 4가지의 주요 요인을 얻을 수 있었다.

4. 이들 4개 요인의 상대적 중요성은 향후 사고 방지, 태도에 대한 불만, 책임추궁, 보상의 순으로 중요하였다.

5. 의료분쟁 제기 요인에 영향을 미치는 변수를 분석하기 위해 다중 회귀분석을 한 결과 의사 태도에 대한 불만요인에는 진료과목, 태도에 대한 만족도가 의미있는 관련이 있었으며 책임 추궁 요인에는 진료 과목, 환자의 상태, 사고가 삶에 끼친 영향, 의사의 태도에 대한 만족도가 보상요인에는 학력, 진료과목, 환자의 상태, 사고가 삶에 끼친 영향이 의미있는 관련이 있었다.

이와 같은 결과로 의료분쟁을 제기하는 요인은 다양하며 이들 요인에는 사회인구학적 특성 및 의사의 태도, 사고의 특성, 사고가 삶에 끼친 영향 등이 관련되어 있음을 알 수 있었다. 이 연구에서는 의료사고 경험자중 의료사고 가족 연합회에 사건을 의뢰했던 경우만을 대상으로 하였고 연구대상이 적어 본 연구결과로 우리나라 의료분쟁의 실태를 일반화시키는 데에는 제한점이 따른다. 향후 의료사고를 경험했으나 의료분쟁을 제기하지 않은 가족들을 대조군으로 하는 연구 및 보다 많은 기관을 통해 접근한 의료분쟁을 제기하는 이유에 대한 연구가 필요하리라 생각된다. 의료분쟁 해결에 실질적인 도움을 줄 수 있는 의료분쟁 제기원인에 관련이 있는 다양한 요인에 관한 연구들이 수행되기를 기대한다.

To examine the reasons and characteristics that patient and their families take medical dispute, I surveyed 234 patient and families who were inquired to medical malpractice family association.

The result were as follow:

1. In many cases, the degree of satisfaction a explanation and attitude of doctor and hospital was less than 10%

2. In many cases, patients and their families were severely affected with their lives by medical malpractice

3. Four main themes emerged from the analysis for dispute; dissatisfied with doctor's attitude, wanted to prevent similar incident in the future, call to account, compensation.

4. The relative importance of each of these four main themes was wanted to prevent similar incident in the future, dissatisfied with doctor's attitude, call to account, compensation in the orders of importance.

5. Multiple regression analysis was used to identify the variables relevant to these four main themes clinical speciality group, degree of satisfaction at attitude were significantly associated with the dissatisfied with doctor's attitude. clinical speciality group, patient's condition, effect of medical malpractice on life, degree of satisfaction at attitude were significantly associated with the call to account and academic career, clinical speciality group, patient's condition, effect of medical malpractice on life, degree of satisfaction at attitude were significantly associated with the dissatisfied with doctor's attitude

From the above results, the reasons patients and their families take medical dispute were various and associated with demographic characteristics, doctors' attitude, effect of incidents of life, et.al.

I think case-control study with patients and families who had not take medical dispute in spite of experiencing medical malpractice, and study of medical dispute by involving more institution are needed. I hope further studies that concern various factors relevant to reasons take medical dispute are performed.
