진료과오와 의사의 주의의무

Abstract

국민의 의료수요가 증가하면서, 이에 비례하여 의료사고가 빈번히 발생하고 있으며, 이로 인해 야기되는 의료분쟁은 점차 심각한 사회문제로 대두하게 되었다.

그러므로 본 연구에서는 의료사고를 미연에 방지하고자 하는 입장에서, 약20여년간 국내에서 발생한 의료사고 사례중 진료과오를 분석하여 그 유형의 구조적 특성을 살펴본 바, 오진, 치료, 수술, 수혈 및 투약 등에 진료과실이 많았음을 발견 할 수 있었고, 의사의

주의 의무 판정기준에는 의학의 진보성과 종속성, 그리고 평균적 보통 의사가 행해야할 일반적 주의의무에 따라야할 것이며, 의료제도, 전문의와 비전문의, 긴급성 및 지역적인 차이, 진료의 곤란성, 그리고 치료의 재량성에 따라 의사의 주의의무가 다르다는 것을 알 수 있었다.

그러나, 의료사고에 관한 모든 것을 논함에 있어서는 의료의 고유한 특성이 고려되어 의료위축의 악순환이 없어야 될 것은 물론, 분쟁 당사자인의사나 환자 등의 어느 한쪽도 법적인 불이익이 없어야 할 것이고, 국가기관이나 일반 사회도 각각 서로 다른 입장을 이해하고, 협조하여 명랑하고 적정한 의료풍토를 조성하는데 노력하는 것이 복지국가를 건설하는 가장 바람직한 길이라 생각하고 있다.

In proportion to the increase of medical demand, medical accidents are taking place more frequently, and conflicts between the concerned are becoming severe social problems.

In an effort to understand and prevent medical accidents, malpractice cases of the last 20 years in this country were analysed 1 from studing the types of structural characteristics, it was found that malpractices in diagnosis, treatments, operational, blood transfusions and medications occured most often.

It became evident that physicians should have a standardization in attentative obligations set at a level of which average physicians s practice.

These obligations can be variable according to medical systems, emergency situations, regional differences, degree of difficulty in diagnosis and discretionary powers in service.

A vicious cycle of less action by the physician due to fear of malpractice causes core accidents to occur.

Legal disadvantage to the disputed physicians or patients should be prevented.

Moreover the government and general society should try to understand each others position and cooperate.

This is so that we can establish a cordial and sound atmosphere in the medical field which could be one helpful way in forming a welfare state.
