소생 불가능한 중환자에 대한 치료중단은 중환자실에서 흔히 만날 수 있는 문제이다. 그러나 치료중단의 결정은 법적·윤리적 문제를 야기할 수 있는 매우 첨예한 문제이지만 지금까지 우리 나라에서 중환자의 치료중단에 대한 연구를 찾아볼 수 없었다. 이에 본 연구는 중환자실에서의 치료중단 현황과 치료중단을 결정한 중환자의 특성을 분석하고 결정과정을 파악하여, 소생 불가능한 중환자의 치료중단 의사결정에 대한 윤리적 지침이나 정책에 필요한 기초자료를 제공하기 위하여 시도된 후향적이고 서술적인 조사연구이다.

연구대상은 중환자실에서의 치료중단 현황과 치료중단을 결정한 중환자의 특성을 파악하기 위하여 1999년 1월 1일부터 4월 30일까지 서울 시내 소재 대학부속종합병원 1개의 중환자실 입실환자 중 치료중단을 결정한 환자 31명의 의무기록지를 분석하였다. 치료중

단 결정과정과 관련된 의료인의 인식을 파악하기 위하여 의사 36명과 2개의 중환자실에 재직중인 간호사 45명을 대상으로 설문조사 하였다.

연구도구는 연구자가 문헌고찰을 통하여 치료중단의 현황과 중환자의 특성을 분석하기 위해 작성한 분석표와 치료중단 결정과정에 대해 의료인의 인식을 파악하기 위하여 작성한 설문지 사용하였다.

자료수집은 1999년 4월 8일부터 5월 2일까지 연구자에 의하여 직접 실시되었으며, 수집된 자료는 SAS 통계 프로그램을 이용하여 분석하였다. 치료중단의 현황과 중환자의 특성을 빈도와 비율, 평균과 표준편차로 분석하였고, 치료중단의 결정과정을 빈도와 비율로 분석하였다. 임상적 특성간의 차이를 paired t-test를 통해 95%의 신뢰구간을 구하여 통계적 유의도를 검증하였다. 본 연구의 결과는 다음과 같다.

중환자실에서의 치료중단으로

1. 중환자실에서 가장 많이 시행되는 치료중단 형태는 No CPR이었고 그 다음으로 가망없는 퇴원, 더 이상의 적극적 치료 시행 안함, 의학적 충고에 반한 퇴원, 진행치료 중단의 순이었다.

2. 치료중단에 대한 의사처방이나 가족들의 동의서가 기록으로 없는 경우가 각각 61.3%, 45.2%이었다.

3. 치료중단 결정시 가족들의 참여가 80.7%에서 의무기록에 기록되었는데, 그중 자녀가 41.9%로 가장 많이 참여하였다.

4. 치료중단 후 환자의 생존기간은 개인차가 많았으나 평균 7시간이었고 환자의 90% 이상이 치료중단 후 1일 이내에 사망하였다.

5. 치료중단을 결정한 중환자의 특성 중 일반적 특성으로 치료중단을 결정 하는 비율이 가장 높게 나타난 연령층은 70세 이상이었고 60세 이상이 54.7%를 차지하였으며, 남자가 많았다. 호흡기계 질환의 비율이 높았고, 단일 질병으로는 급성 호흡곤란 증후군과 패혈성 쇽이 많았다. 중환자실 재원기간은 19일 이내로 비교적 짧은 경우가 많았고, 1년 이내의 유병기간이 64.4%이었다.

6. 치료중단을 결정한 중환자의 임상적 특성으로 의식상태는 중환자실 입실시 명료한 경우가 41.9%이었으나 치료중단시는 6.5%이었다. Glasgow Coma Scale에 의하면 평균이 9.9점인 중등도 의식장애이었으나, 치료중단시는 평균 7.1점인 중증 의식장애로 입실시에 비해 치료중단시 현저한 의식수준의 저하를 나타냈으며, 통계적으로 유의하였다(t=4.23, P<0.05). 중환자의 중증도를 나타내는 APACHE Ⅱ 점수가 입실시 평균 20.4점이었으나, 치료중단시 25.1점으로 질병의 중증도가 증가한 것으로 나타났고 통계적으로 유의하였다 (t=4.00, P<0.05). 치료중단시의 Multiple Organ Failure에 의한 장기부전 수는 평균 4.1개였고 평균점수는 7.1점이었으며, 호흡기계의 부전이 가장 많았다.

7. 간호사와 의사가 인식하는 치료중단의 결정이유로 소생 불가능하리라는 의학적 판단이 1위를 보호자나 환자의 요구가 2위, 중위순위에 환자의 고령, 고통경감이었고, 하위순위에 경제적 상태의 고려와 한정된 의료자 원의 유용한 활용으로 나타났다.

8. 치료중단시 가장 많이 시행되는 형태로 간호사와 의사가 인식하고 있는 것은 No CPR이었고 치료중단까지의 토론횟수는 2∼3회가 가장 많았다.

9. 치료중단 결정은 대부분 의사와 가족의 합리적 토론을 통해 이루어지는 것으로 나타났다. 의료인과 환자가족과의 의견대립시 다시 환자의 상태를 설명하여 설득하나 가족들의 요구대로 모든 치료를 행한다고 인식하는 간호사와 의사가 33.3%이었다.

10. 치료중단 결정시 제안자로는 의사와 가족이, 결정권자로는 가족인 것으로 인식하였다. 치료중단 결정에 있어서 의료인의 역할로는 상담자, 조정자의 역할이 높은 비율을 차지하였으나 간호사의 경우 22.2%에서 방관자, 제3자, 아무 역할 없음 등으로 인식하고 있어 간호사가 치료중단 결정과정에서 많은 경우 소외되고 있음으로 나타났다.

11. 치료중단의 문제점으로는 의사결정시 환자의 의견이 반영되지 못함과 윤리적으로 의사결정 할 수 있는 기관의 부재, 법률적 보호의 미비, 경제적 여건으로 요구할 시의 대책이 없음과 의사결정이 의사나 가족에게 편중되어 있다는 순으로 인식하고 있었다.

12. 치료중단시의 문제점을 해결하기 위한 대안으로는 소생 불가능하리라는 의학적 근거와 가족들의 요구와 동의서, 환자의 사전의사결정서 등이 상위순위를 차지하였고 중위순위에 의료인의 합의, 병원윤리위원회 등의 자문기관의 승인이었으며 법률과 사회적 승인, check list 등의 형식적 도구는 하위순위로 나타났다.

치료중단 결정과정은 사회적 논의를 통해 합의에 이르러야 한다. 치료중단을 결정하는 상황에 대한 판단적 기준이 있어야 하고 환자의 자율적 의사결정을 최대한 반영할 수 있는 방법과 제도적 장치가 모색되어야 한다. 또한 의료사회 전반에 걸쳐 기준이나 지침을

제시할 수 있는 병원윤리위원회를 조직, 활성화해야 하고 치료중단을 결정하는데 원칙을 설정하고 사회적 법제 제도를 연구하고 시행할 수 있는 권위 있는 기관의 활동이 필요하리라 여겨진다.

These days, withdrawing care from the critically ill patients who do not have a chance of recover has become one of the processes of care. This is due to the change in perception of health care team. The purpose of this study was to understand the circumstances surrounding the care withdrawal cases by analyzing the characteristics of the patients from whom the care was withdrawn and the decision making processes. This study is a descriptive retrospective research that aims to provide an ethical guidance and basic data for policy making. In order to analyze the cases of withdrawing care and characteristics of the critically ill patients from whom the care was withdrawn, medical records of 31 patients were reviewed. To identify the perceptions health care teams regarding the decision-making process of withdrawing care, the doctors and nurses in the Intensive Care Units were surveyed.

The results of this study are as follows:

1. The most common type of withdrawing care was No CPR. In many cases, there were neither DNR orders nor written consents of the families. In the decision making process, patients daughters or sons were the main decision-makers. The survival time after withdrawing care was usually not long. More than 90% of patients expired within a day after the care was withdrawn.

2. Many of the patients from whom the care was withdrawn had respiratory diseases. Both the times spent in the ICU before care was withdrawn and the time the patients had had the diseases were relatively short. Mental status and severity of the

disease were extremely deteriorated in the APACHE II and GCS scores. By the MOF average failure organ number was 4.1 and the score was 7.1.

3. In the perception of the health care team about the withdrawing care, the main reasons of the withdrawal, in the order of most to least, were medical determination that the patient was hopeless, demand of the family of the patient, old age, and relieving the pain. The most common type of withdrawing care was No CPR. Two or three discussions were made before withdrawing care. If the decision is made to withdraw care, it was recommended by both physicians and families, however, the final decisions were made by the family. The patients and nurses were usually excluded in the decision-making processes. As for the problems associated with the withdrawing care, lack of patient's opinion in the decision process, lack of an organization that can make ethical decisions and lack of legal protection were ranked high. Patient's pre-treatment decision, medical evidence indicating the patient cannot recover, and request and consent of the family were ranked high as recommendations to the aforementioned problems.

In summarizing this study, the decision process to withdraw care from the critically ill patients should be agreed from public discussions. There should be a standard guidance in support of decision making process when determining whether

to withdraw the care. A method that reflects the patient's own desire in the decision making and a system that can implement the method should be sought. A medical ethics committee that provides standards and guidance should be formed and widely utilized. In addition, we need an institution which provides criteria in withdrawing care, and studies and implements legal system.
